The Kailashahar Sub-divisional Administration under Unakoti District has clamped 163 of BNSS in the entire sub-division on the ground of continuing communal tension between Hindu and Muslim Community and seriousness of the Law and Order situation.
As order undersigned by Kailashahar Sub-divisional Magistrate, Pradip Sarkar said that Superintendent of Police, Unakoti District has recommended to impose section 163 BNSS at Kailashahar Sub-Division on the ground of continuing communal tension between Hindu and Muslim Community and seriousness of the Law and Order situation.
“AND WHEREAS, I, Pradip Sarkar, TCS-I, Sub-Divisional Magistrate, Kailashahar, Unakoti District is further instructed by higher authority to impose section 163 of BNSS as per the inputs of SP, Unakoti District. AND NOW, therefore…in exercise of power conferred u/s 163 of Bharatiya Nagarik Suraksha Sanhita, 2023 hereby pass Order to prohibit any kind of assembly consisting of five or more person with or without weapons or weapon like objects such as Lathi, Sticks, Iron Rods, Bamboos, Stones or any object which may be used as weapon of offence and also hereby prohibit holding of any public meeting, rally, gathering, public address with or without use of loudspeakers, plying of vehicles/ motor bike not more than two together on the road etc. anywhere around the Kailashahar Sub- Division of Unakoti District with above restrictions from October 16 to until the situation normalizes”, the order reads.
It said that movement of Paramilitary Force and State Police personnel engaged in maintenance of Law and Order, movement of Public, authorized by the S.P. Unakoti District, SDPO- Kailashahar Sub-Division and from office of the undersigned. discharge of emergent official duties and movement of Government servants when it is essential on movement of patients requiring immediate treatment.
“Gathering for educational purposes at various Educational Institutions during the day time, Routine functioning of Government or Private Offices, normal religious gatherings at the time of prayers in religious places of worship or social functions such as marriage, birthday ceremony etc, normal business and transactions in all the Markets and Religious places accept that of any gathering. In view of the emergent nature of situation and with a view to ensure public peace and tranquility, this order is passed ex parte. Any person violating order shall be liable to be prosecuted U/S 223 of Bharatiya Nyaya Sanhita”, the order reads.
